Everyone should have some type of estate planning in place, whether it’s very simple or complex.  The Law Office of Jeremy D. Price provides comprehensive legal services to individuals and families of all ages and wealth.  Our serves include wills, trusts, probate, asset protection, and powers of attorney.  Working with an attorney provides you with essential advice enabling you to create an estate plan tailored to your individual values and circumstances.

Whether you have no children or a large family, creating a comprehensive estate plan creates a plan for controlling assets and preserving a family legacy.  Death, long-term sickness, and incapacity are difficult topics to think about.  A little planning upfront though saves significant heartache and uncertainty in the future for yourself and your loved ones.

Plan today to take control of your assets in life and death.  Estate planning enables you to authoritatively state how you want your assets (or “estate”) distributed after your death and who you want to care for your children in the event of your death.  Additionally, it enables you to put in place trusted individuals to act on your behalf if you become incapacitated.

Failing to plan is the decision to give up control. If you do not make key decisions when you have the opportunity you will miss out on determining how your well-earned assets and wealth will be distributed.  Instead of your wishes, those decisions will be made by the laws of the state in which you live. In many cases the distribution of assets mandated by state law is inconsistent with a person’s dying wishes.  Additionally, planning now enables your family to remain free from the oversight of the court system and a court appointed conservator if you are incapacitated or are no longer capable of making decisions on your own.

At the most basic level this involves drafting a will that states how you want your assets distributed, including who gets what. Assets that transfer under a will require the court administered process of probate.  Probate can be a lengthy and complex process.  It can also be avoided.

In California, if you have real estate or assets with a total value of $150,000, a living trust will likely be more appropriate: estate planning with the advice of an attorney is essential.  A living trust is allows the assets of the trust to transfer to the stated beneficiary without probate in a private process that is not held up by the calendar of the court.
